Death Scenario Assistance - Trailers (1,999 lbs and under)
Processing Information for Trailers

Because Florida does not issue titles for trailers (weighing 1,999 lbs and under), when completing a transaction involving a death, there are a few exceptions to the requirements outlined in the Death Scenario Assistance results:

 If directed to complete the "Transfer of Title by Seller" section of the Florida title, you must complete and submit a notarized or perjury clause Bill of Sale instead. 

 If directed to compete an HSMV 82040 MV or HSMV 82041, you must complete and submit an affidavit instead. All heirs and applicants must sign the affidavit. This affidavit must attest that:

<<Deceased's Name>> is deceased and a copy of his/her death certificate and Will (if applicable) is attached. <<Name(s) of Heir(s)>> hereby release their right, title, interest and claim as heirs at law, legatees, devisee, or otherwise to the aforesaid motor vehicle to <<Name(s) of Applicant(s)>>.


 If directed that a specific individual (i.e., heir(s), Personal Representative, etc.must transfer the title into their name prior to selling, this requirement does not apply to trailers (weighing 1,999 lbs and under). The trailer may be sold so long as the purchaser is provided with all ownership documents that make up the "complete chain" of ownership (including completing the Out-of-State title or the Bill of Sale for transfer to the new purchaser).
